Guilty Plea In 2009 Fatal Drunk Driving Accident

Cook County prosecutors have secured a 10-year prison sentence for Melrose Park man whose blood alcohol content was nearly twice the legal limit when he caused a fatal accident last summer that killed a 55-year old Norridge man according the Office of Cook County State’s Attorney Anita Alvarez.

Daniel Martinez, 24 of 1112 N. 24th Ave pled guilty today to one count of aggravated driving under the influence before Judge Carol Kipperman at the Maywood Courthouse.

On May 31, 2009 at about 10:15pm, Martinez was spotted driving erratically by Elmwood Park Police. When they attempted to pull him over he initially pretended to pull to the side of the road but then fled the scene. The defendant then proceeded to lead officers on a high- speed chase through Elmwood Park and River Grove.

When Martinez approached the intersection of Grand and Thatcher in River Grove, he ran the red light broad siding and killing the victim Henry Manso. The defendant was arrested and it was determined that his BAC was .155 at the time of the accident. Further testing found cocaine in his system as well.

Judge Kipperman today sentenced Martinez to 10 years in prison. The defendant must serve 85% of his term before he is eligible for parole.
