Devine Names Schaumburg Remodeling Company In Suit
State's Attorney Richard A. Devine filed a lawsuit today in Cook County Circuit Court against Sunroom Creations, Inc., it’s founder, Dorsie Wayne Mosher Jr., and it’s president,
Dorsie Wayne Mosher III. The suit charges them with violating the Illinois Consumer Fraud
and Deceptive Business Practices Act after they failed to furnish sunrooms for consumers or
provide refunds.
The lawsuit was filed after the State’s Attorney’s Office received complaints from 19 consumers
who paid a total of over $250,000 to Sunroom Creations, formerly located at 902 Albion Avenue
in Schaumburg, Illinois, to install sunrooms at their homes.
The suit alleges that the defendants continued to collect thousands of dollars from their customers
for sunrooms even though they knew, or should have known, that Sunroom Creations could not
obtain the necessary parts and components to build any sunrooms. In August of 2006, Sunroom
Creations closed its doors, and the company filed bankruptcy in September of 2006.
During 2005 and 2006, Sunroom Creations contracted with and obtained thousands of dollars
from their customers to provide sunrooms. At the same time, Sunroom Creations was experiencing
financial difficulties and owed its principal supplier at least $50,000. In March of 2006, this
supplier suspended the delivery of sunroom parts and components to Sunroom Creations, and
Sunroom Creations could not secure another supplier.
The lawsuit seeks to bar the defendants from owning or operating a home repair and remodeling
business in Illinois, refunds for consumers and fines of $50,000 or more against the defendants. “Consumers who put their trust and money in home repair companies expect to receive the services
they pay for,” said Devine. “Unscrupulous and dishonest businesses who act fraudulently are not
above the law.”
