Devine Names Morton Grove Business in Immigration
Fraud Suit
State's Attorney Richard A. Devine has
filed a consumer fraud action against John W. Wozniak,
for pretending to be an attorney and falsely promising
to obtain work permits, Social Security cards,
and green cards for Polish and Eastern European immigrants.
The complaint filed on Thursday, alleges that Wozniak,
d/b/a W. Consulting, Inc., Advocate Group
for Immigrants, practiced law without a license, wrongfully
collected attorney's fees, and illegally operated
an immigration services business from an office at
5920 W. Dempster, Suite 200, in
Morton Grove. Wozniak is alleged to have charged $10,000
to represent a client who sought
a work permit, social security card and two green
cards. He also collected $4,500 from a client and
then failed to secure the promised legal documents.
Under Illinois law, immigration assistance
service providers may not charge fees in excess of
$20 per hour and may only perform minor
services relating to immigration matters.
The suit also charges Wozniak with failing
to register his immigration assistance business
with the State and with numerous violations of law
designed to protect the public from
immigration fraud. Specifically, the complaint charges
that Wozniak failed to post required signs
and disclaimers advising the public that he was not
a licensed attorney or accredited representative,
and could not give any legal advice or accept attorney's
fees. Wozniak also allegedly failed to
maintain the necessary malpractice insurance or surety
bonds, and failed to provide written
contracts to consumers.
The lawsuit seeks an emergency temporary
restraining order to shut down Wozniak's
immigration consulting business, pending further order
of court. The lawsuit seeks a refund for
consumers and a $50,000 fine.
"I want Illinois immigrants and consumers to
know that immigration fraud will be vigorously
prosecuted", said Devine. "It is always
troubling to discover that an individual is preying
upon
his own ethnic community, who merely seek to live
and work lawfully in the United States".
