Andrea Martinez is the State’s Attorney for the District of Utah

Officials have named the interim Top Federal Prosecutor for the District of Utah, who will replace the longest-serving U.S. Attorney in the history of the United States. First Assistant U.S. Attorney Andrea T. Martinez is the first Latina and third woman to be appointed as Acting U.S. Attorney for the District of Utah. She is taking over in the United States Attorney’s Office, replacing the departing U.S. Attorney John Huber, who has served as Chief Federal Law Enforcement Official under two presidential terms. The resignation of U.S. Attorney Huber was in accordance with the request of President-elect Joe Biden and with the instruction provided by Acting U.S. Attorney General Monty Wilkinson on February 9, 2021. During an all-U.S. Attorney call, Acting U.S. Attorney Wilkinson tasked the 55 Trump-appointed Top Federal Prosecutors who were still in a position to vacate their posts on or before February 28, 2021. Such order was to be expected in the transition process into a new administration. According to the Federal Vacancies Reform Act, First Assistant U.S. Attorney Andrea T. Martinez will begin performing duties as Acting U.S. Attorney for the District of Utah on March 1, 2021, extending her term as first-in-command in the Office for a maximum of 300 days, or until a successor has successfully been nominated and confirmed by the Biden Administration.

 

Appointment

First Latina and third woman to be appointed as interim Chief Federal Law Enforcement Official for the District of Utah, First Assistant U.S. Attorney Andrea T. Martinez is the new Acting U.S. Attorney for the district. By virtue of the Federal Vacancies Reform Act, Martinez will be replacing the longest-serving U.S. Attorney in the nation—outgoing U.S. Attorney John Huber. Leaving his post after six years of serving as the Top Federal Prosecutor for the District of Utah under former President Barack Obama and former Donald Trump, U.S. Attorney Huber is departing the Office, as per the request of President-elect Joe Biden. Outgoing U.S. Attorney Huber has tendered his letter of resignation on February 10, 2021, following the all-U.S. Attorney call led by Acting U.S. Attorney General Robert M. “Monty” Wilkinson the previous day. The aforementioned call was made to instruct the remaining 55 Trump-appointed Chief Federal Law Enforcement Officials to step down in order to allow the new administration to put forth nominations for new Top Federal Prosecutors for the 94 districts across the nation. First Assistant U.S. Attorney Andrea T. Martinez is taking over in the Office on March 1, 2021, and will continue to lead the Office as Acting U.S. Attorney for the subsequent 300 days or until a permanent U.S. Attorney has been nominated and confirmed by President Joe Biden and the Senate, respectively.

 

Educational Background and Bar Admission

U.S. Attorney Andrea Martinez is a native of Utah. She graduated from the University of Utah in 1998, earning a degree in Bachelor of Arts with a double major. She then pursued studying law at the University of Utah S.J. Quinney College of Law, from where she received her Juris Doctorate in 2001. Acting U.S. Attorney Martinez has been granted admission into the Utah State Bar since 2002, where she has remained an active member since.

 

Legal Career – Government Service

Embarking on a legal career in government service, Acting U.S. Attorney Andrea Martinez joined the Office of the District Attorney for Salt Lake County as an Assistant District Attorney. In this capacity, she was able to focus on prosecuting criminal cases, particularly those involving aggravated assault, homicide, narcotics, and cases under the Special Victims Unit. Throughout her service in the Salt Lake County District Attorney’s Office, U.S. Attorney Martinez served as a state prosecutor under the Juvenile Division and Misdemeanor Division of the Office.

 

Legal Career – Office of the United States Attorney

Acting U.S. Attorney Martinez is a career prosecutor who has dedicated her professional life of almost two decades to public service and has committed more than a decade to perform duties in the Office of the United States Attorney for the District of Utah. Given the length of her service in the Office, U.S. Attorney Martinez has handled an array of violent crime prosecutions. She has been involved in investigating and prosecuting cases associated with child exploitation, drug trafficking, and federal firearms. On top of that, she has prosecuted cases in the Indian Country.

Throughout her, more than ten years of serving in the United States Attorney’s Office for the District of Utah, interim Top Federal Prosecutor Andrea Martinez has held several leadership positions in the Office, including being a Violence Against Women Act Coordinator, a Project Safe Childhood Coordinator, and District Diversity Chairperson. Apart from that, she has also been previously appointed as Senior Litigation Counsel and Violent Crime Deputy Section Chief.

 

Office Jurisdiction

Being the newly appointed interim Chief Federal Law Enforcement Official for the District of Utah, Acting U.S. Attorney Andrea Martinez now leads an office of 85 employees, consisting of 45 Assistant U.S. Attorneys and 40 support personnel. Together, the Office of the United States Attorney for the District of Utah shall prosecute federal crimes, enforce civil statutes, defend the United States against all lawsuits within the district, and enforce federal law on Indian reservations and federal facilities. Moreover, the Office shall serve and protect the entire State of Utah, which comprises 29 counties and a population of approximately 2.8 million.
