For a second time, First Assistant U.S. Attorney John J. Farley has been tapped to step up as the Acting U.S. Attorney in the Office of the United States Attorney for the District of New Hampshire. He is to replace the departing U.S. Attorney Scott W. Murray temporarily. The latter has been asked to tender his letter of resignation to President-elect Joe Biden as the Biden Administration transitions into taking office in the U.S. government. Murray is among the 55 U.S. Attorneys who were tasked by Acting U.S. Attorney General Monty Wilkinson last February 9, 2021, to vacate their posts and allow the nomination of new Top Federal Prosecutors across the 94 district of the United States. By virtue of the Federal Vacancies Reform Act, First Assistant U.S. Attorney John J. Farley will begin serving as the interim Chief Federal Law Enforcement Official for the District of New Hampshire on March 7, 2021. As he previously have done from March 2017 to March 2018, Acting U.S. Attorney John Farley will lead the Office of the United States Attorney for the District of New Hampshire for a maximum period of 300 days, or until a permanent successor has officially been named.

Appointment
John J. Farley of the U.S. Attorney’s Office for the District of New Hampshire has been named as the state’s interim Chief Federal Law Enforcement Official. First Assistant U.S. Attorney John Farley is expected to take the reigns from the outgoing U.S. Attorney Scott W. Murray. The latter is stepping down from the highest position in the Office of the United States Attorney for the District of New Hampshire in line with the takeover of a new administration. Acting U.S. Attorney General Robert M. “Monty” Wilkinson, on behalf of the U.S. Department of Justice and the Biden Administration, has led an all-U.S. Attorney call in the morning of February 9, 2021, delivering the request of President-elect Joe Biden. During the meeting of the Acting U.S. Attorney General and the U.S. Attorneys, Top Federal Prosecutor Scott Murray, along with the rest of the remaining 56 Trump-appointed Chief Federal Law Enforcement, have been asked to vacate their positions in line with the transition from one administration to another. Pursuant to the Federal Vacancies Reform Act, First Assistant U.S. Attorney John J. Farley will serve as the interim Top Federal Prosecutor in the Office of the United States Attorney for the District of New Hampshire beginning on March 7, 2021, until a new Presidentially-appointed U.S. Attorney takes Office.
Educational Background and Bar Admissions
Acting U.S. Attorney John Farley graduated from the University of Notre Dame with a Bachelor of Arts in Government and International Studies degree. He later attended the Georgetown University Law Center, where he earned his Juris Doctorate. Following his graduation in 1993, U.S. Attorney Farley was granted admission into the Pennsylvania Bar Association, and into the District of Columbia Bar in 1995. Top Federal Prosecutor Farley remained active in the District of Columbia Bar but inactive in the Pennsylvania State Bar.
Legal Career
Becoming a Law Clerk under a Federal District Judge after his graduation from law school, U.S. Attorney Farley embarked on a legal career that was fully dedicated to government service. Through the Attorney General’s Honors Program – the nation’s premier entry-level federal attorney recruitment program, Acting U.S. Attorney Farley became a part of the Department of Justice in 1995. He initially performed duties as an attorney in the Narcotics and Dangerous Drug Section of the Department of Justice. He was involved in prosecuting drug cases in different states such as in California, Puerto Rico, and Texas.
Prior to joining the U.S. Attorney’s Office for the District of New Hampshire, Acting U.S. Attorney Farley was first a part of the Office of the United States Attorney for the District of Massachusetts in Boston. For approximately six years, beginning in 1998 to 2004, U.S. Attorney Farley served as an Assistant U.S. Attorney in the Office. He focused on the prosecution of drug and public corruption cases. Upon joining the Office of the U.S. Attorney for the District of New Hampshire in 2004, U.S. Attorney John Farley worked as an Assistant U.S. Attorney in the Office’s Civil Division. In the next eight years of his career, Acting U.S. Attorney Farley handled Affirmative Civil Enforcement matters, particularly those involving civil health care fraud, and civil rights issues. In 2012, U.S. Attorney Farley moved to being a part of the Office’s Criminal Division. He managed the prosecution of an array of criminal cases and eventually became the Lead Task Force Attorney for the Organized Crime Drug Enforcement Task Force.
Service as First Assistant U.S. Attorney and as Acting U.S. Attorney
Serving for more than 25 years as an Attorney in the United States Department of Justice, interim Chief Federal Law Enforcement Official John Farley has demonstrated prowess in the prosecution of both civil and criminal cases, along with his proficiency in administrative work. He has served as the First Assistant U.S. Attorney in the Office of the U.S. Attorney for the District of New Hampshire since 2016. As second-in-command, Acting U.S. Attorney Farley was responsible for overseeing the civil, criminal, and administrative divisions in their daily operations. On top of being First Assistant U.S. Attorney for two terms, Top Federal Prosecutor John Farley is now on his second term as Acting U.S. Attorney. He first held the position from March of 2017 to March of 2018, following the resignation of former U.S. Attorney Emily Gray Rice and prior to the appointment of former U.S. Attorney Scott Murray. Interim Chief Federal Prosecutor John J. Farley is also in the Federal Court Advisory Committee of the United States Department of Justice, where he shall serve as a liaison between the bench and bar and a sounding board on the many issues facing the court.
Office Jurisdiction
The Office of the United States Attorney for the District of New Hampshire will be led by John J. Farley as its Acting U.S. Attorney for a maximum of 300 days following his appointment, or until a new U.S. Attorney has been appointed. Under his leadership, the Office shall continue to prosecute criminal cases brought by the Federal government and prosecute and defend civil cases in which the United States is a party. Apart from that, the U.S. Attorney’s Office shall enforce the collection of debts that are owed to the United States.
