Seth D. DuCharme states attorney for the Eastern District of New York

Acting United States Attorney for the Eastern District of New York, Seth D. DuCharme was appointed by Attorney General William P. Barr pursuant to the 5 U.S.C. § 3345(a)(3), effective July 10, 2020, and was subsequently sworn into the office by the United States Chief District Judge Roslynn R. Mauskopf, following the resignation of former State’s Attorney Richard Donoghue.

Education

U.S. Attorney Seth DuCharme earned his undergraduate degree from Hamilton College in 1992, graduating with Honors in English Literature. Moreover, he received his Juris Doctorate from the Fordham University School of Law in 2003, graduating cum laude and receiving Order of the Coif. He also was an editor on the Fordham Law Review.

Legal Career

In 1996, Seth DuCharme was Deputy Marshal to the United States Marshals Service for four years, until June of 2000. In this capacity, he worked as a federal law enforcer who was responsible for several functions, including witness protection, threat assessment, operational support of U.S. federal courts, and fugitive apprehension.

Following his graduation from law school, U.S. Attorney Seth D. DuCharme officially began his legal career as a law clerk under the Honorable Richard Owen of the United States District Court from 2003 to 2004. Later on, Seth DuCharme switched to private practice and joined the Simpson Thacher & Bartlett L.L.P. as an Associate from 2004 to 2008. He belonged to the firm’s litigation department, working primarily on the prosecution of securities fraud, class action insurance, reinsurance arbitration, among other complex matters.

Seth DuCharme joined the United States Attorney’s Office for the Eastern District of New York in 2008, serving as an Assistant United States Attorney until 2020. He served in the office for 12 years, where he became Chief of the National Security and Cybercrime Section of the United States Attorney’s Office in 2015. U.S. Attorney Seth D. DuCharme worked as the overall manager who supervised the terrorism, expert control, cyber, and espionage investigations of the States Attorney’s Office. Furthermore, he oversaw matters involving both individual and corporate cases of sanctions under the International Emergency Economic Powers Act and the Office of Foreign Asset Control. He also worked on the unauthorized retention and dissemination of classified information.

Three years later, U.S. Attorney Seth D. DuCharme became the Chief of Criminal Division in 2018. He was the lead supervisor of litigations and prosecutions of a variety of cases, including corporate and securities fraud, public corruption, civil rights violation, international narcotics, cybercrime, among others. 

Through the 12 years of being an Assistant United States Attorney, Seth D. DuCharme has handled numerous cases, including defending the government in its use of electronic surveillance under the Foreign Intelligence Surveillance Amendments Act of 2008. Seth DuCharme also pioneered and founded the Disruption and Early Engagement Program (DEEP) of the United States Attorney’s Office of the Eastern District of New York in 2016. With this endeavor, U.S. Attorney Seth DuCharme has worked in collaboration with the Department of Defense, N.G.O.s, and the Intelligence Community. The “DEEP” aims to strengthen and advance the national security interests of the United States across disciplines. Additionally, Attorney DuCharme has served in the Violent Crimes and Terrorism, General Crimes, and National Security and Cybercrime sections, and was a representative on the Anti-Terrorism Advisory Council.

Honors, Awards, and Publications

The substantive experience and exemplary service of U.S. Attorney Seth DuCharme to the Eastern District of New York have been recognized, including receiving the award Stein Scholars Award for Commitment to Public Service in 2015, which demonstrates DuCharme’s remarkable commitment to public service. The Acting United States Attorney Seth DuCharme has had publications, including Lures and Strikes: [Strategies for Investigations of Foreign Nationals in National Security Cases], which was released in 2013, and The Search for Reasonableness in Use-of-Force Cases: Understanding the Effects of Stress on Perception and Performance, released in 2002.

Volunteer Experience

Along with legal career, Seth DuCharme has also engaged in a number of volunteer experience such us becoming a member of the Board of Directors at The Learning Clinic, and serving as a Self-Defense Instructor at the American Women’s Self Defense Association, in which he was a lead instructor in the rape prevention and self-defence training. 

Office Jurisdiction

As the Chief Federal Law Enforcer for the Eastern District of New York, Seth D. DuCharme oversees Brooklyn, Queens, and Staten Island in New York City. Furthermore, he manages and supervises over 175 attorneys – 115 attorneys belonging to the criminal division and 60 in the civil division.
