Assistant United States Attorney Timothy Duax, the Branch Chief and First Assistant U.S. Attorney of the Office of the United States Attorney for the Northern District of Iowa, was named as the interim Chief Federal Law Enforcement Official. Tim Duax was appointed to the highest position in the Office following the retirement of former U.S. Attorney Sean Berry on January 31, 2022, after over 30 years of service with the Department of Justice. As of February 1, 2022, Timothy Duax serves as the Acting United States Attorney for the Northern District of Iowa until a permanent Top Federal Prosecutor has been named and appointed by President Joseph R. Biden. Until a U.S. Attorney presidential nominee is confirmed, interim Chief Federal Law Enforcement Official Tim Duax shall continue to ensure that the division maintains its vital law enforcement action, vigorously uphold the rule of law, and pursue the impartial and fair administration of justice for the citizens of the Northern District of Iowa.

Educational Background
U.S. Attorney Timothy Duax received his undergraduate degree from Dartmouth College in 1986 and subsequently entered the Arizona State University College of Law, earning his Juris Doctorate in 1989. He was admitted into the State Bar of Arizona the same year he graduated from law school.
Early Legal Career
Prior to joining the Department of Justice, Top Federal Prosecutor Tim Duax spent six years in private practice. He later shifted to government service and joined the Maricopa County Attorney’s Office in Arizona, where he served ten years as a prosecutor. Acting U.S. Attorney Timothy Duax worked as a state prosecutor in the Sex Crimes and Homicide Bureaus of the Maricopa County Attorney’s Office, handling highly sensitive cases involving child pornography, child prosecution, computer-related sex crimes, and sexual abuse of children and adults as well as various types of homicide cases.

Top Federal Prosecutor Tim Duax came into the Office of the United States Attorney for the Northern District of Iowa as an Assistant United States Attorney. In his early years in the Office, Acting U.S. Attorney Duax served in the Organized Crime and Drug Trafficking Section, where he managed to prosecute numerous cases involving the combat against violent drug trafficking organizations, amongst other organized crime. In 2007, interim U.S. Attorney Duax was named the Sioux City Branch Chief and the First Assistant U.S. Attorney to then-United States Attorney Matt M. Dummermuth.

A man with extensive experience in prosecuting child exploitation cases, matters of organized crime, and violent crimes, U.S. Attorney Timothy Duax were recognized by Deputy Attorney General Jeffrey Rosen and Executive Office for U.S. Attorneys Director James Crowell, IV for his superior performance as the Chief of the U.S. Attorney’s Office in the Northern District of Iowa’s Sioux City branch office in 2019. Top Federal Prosecutor Duax was commended for overcoming challenging circumstances during his term as Branch Chief, where he managed to enhance the leadership, productivity, and morale in the Sioux City Office despite having limited resources and having to work through a disruptive construction project.
Litigated Cases
As a Maricopa County Deputy Attorney’s Office prosecutor, Acting U.S. Attorney Timothy T. Duax has worked on an array of criminal prosecutions, including a case of manslaughter and aggravated assault in 2002. Top Federal Prosecutor Duax requested for the defendant to be charged with a total of 17 years – the maximum sentence the law allows for the defendant’s charges. The defendant was later sentenced to fourteen-and-a-half years in prison for assisting in the murder of an Eastern Arizona College student in 1997. During his years serving as an Assistant U.S. Attorney in the Office of the United States Attorney for the Northern District of Iowa, Top Federal Prosecutor Duax has appeared on behalf of the government in several prosecution cases. In July 2010, he represented the government in a lawsuit against a defendant charged with two counts of production of child pornography and one count of possession of child pornography. He has also prosecuted some of the most challenging human trafficking and sexual exploitation cases in the Office of the United States Attorney for the Northern District of Iowa while serving in leadership roles. U.S. Attorney Duax has worked on behalf of the U.S. Attorney’s Office for the Northern District of Iowa in other matters, including prosecuting fraud and drug trafficking and handling tort cases, among other prosecutions and litigations. He has previously worked in collaboration with the FBI on the trial of a defendant who was found guilty of defrauding a Sioux Center bank in December 2009.

Serving as the interim Chief Federal Law Enforcement Official for the Northern District of Iowa, Acting U.S. Attorney Timothy T. Duax leads the Office of the United States Attorney in advocating for and protecting the rights of the 1.3 million residents of the Northern District of Iowa. The Office has jurisdiction over 52 counties in the State of Iowa, including the Meskwaki Indian Settlement in Eastern Iowa and small portions of the Winnebago and Omaha Indian Reservations in Western Iowa. With Acting U.S. Attorney Tim Duax’s mission to protect the public and uphold the rule of law in the Northern District of Iowa are more than 20 dedicated Assistant U.S. Attorneys. Three High-Intensity Drug Trafficking Area (HIDTA) Attorneys and support personnel are also all in a joint effort to pursue the mission of the Office of the U.S. Attorney for the Northern District of Iowa.
